Welcome to https://suppsociety.com.au, This Website is operated by Supp Society Pty Ltd (ACN 679 678 169), referred to in this Policy as “Supp Society”, “our”, “we” or “us”).

These Terms apply to the access and use of the Website, and any of its associated Products or Services including the in store-purchase of Products and Services.

Please read these Terms and conditions (Terms) carefully. By using, browsing and/or reading the Website, or purchasing products from Supp Society this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, or any of Services, immediately.

Supp Society reserves the right to review and change any of the Terms by updating this page at its sole discretion. When we update the Terms, we will use reasonable endeavours to provide you with notice of updates to the Terms. Any changes to the Terms take immediate effect from the date of their publication. Before you continue, we recommend you keep a copy of the Terms.

DEFINITIONS

In these Terms, unless the context otherwise requires:

 

ACL means the Australian Consumer Law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Agreement means these Website Terms of Use, including all policies and any amendments made from time to time.

Customer, you, or your means any person or entity who accesses or uses the Website or places an order through the Website.

Discount Code means a code issued by Supp Society that may entitle the user to promotional pricing or benefits, subject to the applicable promotional terms and conditions.

Order means a request submitted by you to purchase products or services from us through the Website.

Products means the goods and/or services available for purchase via the Website, including those fulfilled by third-party suppliers.

Privacy Policy means our privacy policy available at suppsociety.com.au/policies/privacy-policy, as amended from time to time.

Services means any services offered by Supp Society via the Website, including customer support, order processing, promotional offerings, and fulfilment coordination.

Supp Society, we, us, or our means Supp Society Pty Ltd (ACN 679 678 169), the operator of the Website.

Terms means these Website Terms of Use, as amended from time to time.

Third-Party Provider means any third party engaged by us to provide services related to payment processing, delivery, product fulfilment, or credit arrangements, including but not limited to Zip Pay, Afterpay, Klarna, PayPal, and logistics carriers.

Website means the website located at https://suppsociety.com.au and any associated mobile site or application.

ACCEPTANCE OF THE TERMS

You accept the Terms by remaining on the Website or by purchasing Products or Services from Supp Society. You may also accept the Terms by clicking to accept or agree to the Terms where this option is made available to you by Supp Society.

REGISTRATION TO USE THE SERVICES

As part of your use of the Services, you may be required to provide personal information about yourself (such as identification or contact details), including:

a)     Name;

b)     Date of birth;

c)     Email address;

d)     Payment information;

e)     Mailing/shipping address; and

f)      Telephone number

You warrant that any information you give to Supp Society in the course of completing the registration process is accurate, correct and up to date.

Once you have completed the registration process, you will be a registered member of the Website (Member) and agree to be bound by the Terms.

You may not use the Services and may not accept the Terms if:

a)     you are not of legal age to form a binding contract with Supp Society; or

b)     you are a person barred from receiving the Services under the laws of Australia or other countries including the country in which you are resident or from which you use the Services.

YOUR OBLIGATIONS

By accessing the Website, you agree to use the Services only for purposes that are permitted by:

a)     the Terms; and

b)     any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.

You have the sole responsibility for protecting the confidentiality of your password and/or email address. Use of your password by any other person may result in the immediate cancellation of the Services.

Any use of your registration information by any other person, or third parties, is strictly prohibited. You agree to immediately notify us of any unauthorised use of your password or email address or any breach of security of which you have become aware.

Access and use of the Website is limited, non-transferable and allows for the sole use of the Website by you for the purposes of us providing the Services.

You will not use the Services or the Website in connection with any commercial endeavours except those that are specifically endorsed or approved by the management of Supp Society.

You will not use the Services or Website for any illegal and/or unauthorised use which includes collecting email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorised framing of or linking to the Website.

Appropriate legal action will be taken by us for any illegal or unauthorised use of the Website.

You acknowledge and agree that any automated use of the Website or its Services is prohibited.

PAYMENT

Payments made in the course of your use of the Services are made using Third-Party Providers. In using the Website, the Services or when making any payment in relation to your use of the Services, you warrant that you have read, understood and agree to be bound by the Terms which are available on their Website.

 You acknowledge and agree that where a request for the payment of the Services Fee is returned or denied, for whatever reason, by your financial institution or is unpaid by you for any other reason, then you are liable for any costs, including banking fees and charges, associated with the Services Fee.

You agree and acknowledge that Supp Society can vary the Services Fee at any time.

BUY NOW PAY LATER PAYMENT OPTIONS

We offer access to the following third-party services that provide buy now, pay later options and low credit financing solutions:

a)     Zip Pay. Minimum monthly repayments are required. A monthly account fee of $9.95 applies and is subject to change. Pay your closing balance in full by the due date each month and we'll waive the fee. Available to approved applicants only and subject to completion of satisfactory credit assessment. Other charges may be payable. Fees and charges subject to change. T&Cs apply. Credit provided by ZipMoney Payments Pty Ltd (ABN 58 164 440 993), Australian Credit Licence Number 441878.

b)     Afterpay. Payments are made in four fortnightly instalments. Late fees may apply for missed payments. Available to approved applicants only. Eligibility criteria and T&Cs apply. See Afterpay’s terms of service for more details. Credit is provided by Afterpay Australia Pty Ltd (ABN 15 169 342 947), which holds Australian Credit Licence Number 527911.

c)     Klarna. Split your purchase into four interest-free payments. Fees may apply for late payments. Available to approved customers only and subject to Klarna’s internal credit assessment. Terms and conditions apply. See Klarna’s website for further information. Credit is provided by Klarna Australia Pty Ltd (ABN 82 635 912 579), Australian Credit Licence Number 527267.

d)     PayPal Pay in 4. Available for eligible purchases between $30–$2,000. Repay in four interest-free payments over six weeks. Late fees may apply for missed payments. Subject to approval and PayPal’s eligibility criteria. Terms and conditions apply. Credit provided by PayPal Australia Pty Ltd (ABN 93 111 195 389), Australian Credit Licence Number 304962.

These Credit Services are provided by independent third-party providers and are not operated, controlled, or endorsed by us.

Credit Services involve financial commitments that may affect your credit rating and financial position. Before entering into any agreement with a credit provider, you should carefully review all terms and conditions; understand all fees, charges, and interest rates; consider your ability to meet repayment obligations; and seek independent financial advice if you are unsure about any aspect of the credit arrangement.

Any agreement you enter into with a Credit Service provider creates a direct contractual relationship between you and that provider. We are not a party to such agreements and have no obligations or liability under them.

REFUND POLICY

We do not offer refunds or exchanges for change of mind.

In accordance with your rights under the Australian Consumer Law, you may be entitled to a replacement or refund of your purchase.

To be eligible for a return under the Australian Consumer Law:

c)     the product must be faulty, damaged, not fit for purpose, or not as described;

d)     you must contact us within a reasonable time from the date of purchase;

e)     proof of purchase is required (e.g., receipt or order confirmation); and

f)      products must be returned in suitable condition for assessment.

Please contact our customer service team before returning any item. If your return is accepted, we will provide instructions for returning the goods.

Products purchased via our Website cannot be returned, exchanged, or refunded in-store, and products purchased in-store cannot be returned, exchanged, or refunded via the Website. All refund, exchange or return requests must be processed through the original point of purchase.

CONSUMER GUARANTEES

The Australian Consumer Law gives you certain guarantees, including that our Services will be rendered with due care and skill, and that the Services will be reasonably fit for purpose.  If we breach those guarantees and you suffer reasonably foreseeable loss or damage, to the extent allowed by the Australian Consumer Law, we limit our liability to any one or more of the following (in our absolute discretion): 

a)     the replacement of any products supplied; 

b)     the repair of any products supplied;

c)     a refund of the Fees paid;

d)     or payment of the cost of you obtaining equivalent Services elsewhere.

The consumer guarantees may not be applicable in circumstances:

a)     where you simply change your mind;

b)     if you cause the problem yourself by misusing our products or Services; or

c)     if you request a service to be done in a certain way against our advice or you are unclear about what you want, 

and no refunds or compensation will be given in these circumstances.

We acknowledge that certain consumer protection legislation implies conditions or warranties into contracts for the supply of goods or Services to consumers that cannot be excluded.

Nothing in this Agreement is intended to exclude or restrict the application of such laws.

You agree that implied Terms under consumer protection laws will not apply to this Agreement where the goods have been obtained for business purposes, provided that the relevant provisions may by law be excluded.

SHIPPING POLICY

Orders placed with Supp Society are fulfilled by third-party logistics providers. We aim to facilitate dispatch on all orders promptly and provide the following estimated delivery timeframes:

a)     Standard Shipping: 2–10 business days (metro areas)

b)     Express Shipping (if selected): 2–5 business days

Please note that these are estimates only, and actual delivery times may vary due to factors outside our control, including but not limited to:

a)     carrier delays;

b)     public holidays;

c)     extreme weather events;

d)     increased demand during peak periods (e.g., sales, Christmas);

e)     supply chain disruptions or stock availability; or

f)      incomplete or incorrect delivery information provided at checkout.

We do not offer refunds, credits or compensation for orders that are delayed in transit.

If your order has not arrived within 14 days of dispatch, please contact our customer support team at info@suppsociety.com.au and we will assist in locating your delivery.

FULFILMENT

We maintain separate stock systems and fulfilment operations for online and in-store purchases. However, certain products may be made available for Click and Collect, with pickup offered at selected Supp Society retail locations. Access to Click and Collect is strictly subject to in-store stock availability. Supp Society does not guarantee the availability of any particular product for Click and Collect at any given time.

Only products currently stocked in the nominated store are eligible for Click and Collect. Products fulfilled from our online warehouse are not eligible for in-store collection, and products will not be shipped to stores for pickup.

Except for approved Click and Collect orders, online purchases cannot be collected in-store, and in-store purchases cannot be shipped, returned, or managed via our online systems.

Click and Collect orders are subject to the same refund and return conditions as all other online purchases and cannot be returned in-store.

SALES AND DISCOUNTS

From time to time, Supp Society may offer sales, promotions or discount codes for use on selected products or categories. All such offers are subject to the Terms outlined below, in addition to any specific conditions stated at the time of the promotion:

a)     discount codes are single-use and non-transferable. only one discount code can be applied per order. discount codes cannot be used in conjunction with any other offer, promotion, or discount, unless explicitly stated otherwise;

b)     some items may be excluded from promotional discounts, including (but not limited to) sale items, bundles, new releases, or third-party products;

c)     discount codes are valid only for the period specified and cannot be applied to previous purchases;

d)     to receive the discount, eligible customers must enter the code at checkout prior to completing payment. we are unable to apply codes retroactively;

e)     we reserve the right to modify or cancel any promotion or discount code at any time without notice; and

f)      in the event that a product is listed at an incorrect price or with incorrect information due to a typographical error, pricing error, or other oversight, supp society reserves the right to refuse or cancel any orders placed for products listed at the incorrect price, whether or not the order has been confirmed or payment processed.

By using a discount code or participating in a promotion, you agree to these Terms.

COPYRIGHT AND INTELLECTUAL PROPERTY

The Website, the Services and all of the related products of Supp Society are subject to copyright. The material on the Website is protected by copyright under the laws of Australia and through international treaties. Unless otherwise indicated, all rights (including copyright) in the Services and compilation of the Website (including but not limited to text, graphics, logos, button icons, video images, audio clips, Website code, scripts, design elements and interactive features) or the Services are owned or controlled for these purposes, and are reserved by Supp Society or its contributors.

All trademarks, service marks and trade names are owned, registered and/or licensed by Supp Society, who grants to you a worldwide, non-exclusive, royalty-free, revocable license whilst you are a user of the Site to:

a)     use the Website pursuant to the Terms;

b)     copy and store the Website and the material contained in the Website in your device's cache memory; and

c)     print pages from the Website for your own personal and non-commercial use.

Supp Society does not grant you any other rights whatsoever in relation to the Website or the Services. All other rights are expressly reserved by Supp Society.

Supp Society retains all rights, title and interest in and to the Website and all related Services. Nothing you do on or in relation to the Website will transfer any:

a)     business name, trading name, domain name, trade mark, industrial design, patent, registered design or copyright, or

b)     a right to use or exploit a business name, trading name, domain name, trade mark or industrial design, or

c)     a thing, system or process that is the subject of a patent, registered design or copyright (or an adaptation or modification of such a thing, system or process).

You may not, without the prior written permission of Supp Society and the permission of any other relevant rights owners: broadcast, republish, up-load to a third party, transmit, post, distribute, show or play in public, adapt or change in any way the Services or third party Services for any purpose, unless otherwise provided by these Terms. This prohibition does not extend to materials on the Website, which are freely available for re-use or are in the public domain.

PRIVACY

You agree that the information which we collect and retain about you can be used in accordance with our Privacy Policy, which is available at suppsociety.com.au/policies/privacy-policy.

GENERAL DISCLAIMER

Nothing in the Terms limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the Australian Consumer Law (or any liability under them) which by law may not be limited or excluded.

Subject to this clause, and to the extent permitted by law:

a)     all Terms, guarantees, warranties, representations or conditions which are not expressly stated in the Terms are excluded; and

b)     Supp Society will not be liable for any special, indirect or consequential loss or damage (unless such loss or damage is reasonably foreseeable resulting from our failure to meet an applicable Consumer Guarantee), loss of profit or opportunity, or damage to goodwill arising out of or in connection with the Services or these Terms (including as a result of not being able to use the Services or the late supply of the Services), whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise.

Use of the Website and the Services is at your own risk. Everything on the Website and the Services is provided to you "as is" and "as available" without warranty or condition of any kind. None of the affiliates, directors, officers, employees, agents, contributors and licensors of Supp Society make any express or implied representation or warranty about the Services or any products or Services (including the products or Services of Supp Society) referred to on the Website. This includes (but is not restricted to) loss or damage you might suffer as a result of any of the following:

a)     failure of performance, error, omission, interruption, deletion, defect, failure to correct defects, delay in operation or transmission, computer virus or other harmful

b)     component, loss of data, communication line failure, unlawful third party conduct, or theft, destruction, alteration or unauthorised access to records;

c)     the accuracy, suitability or currency of any information on the Website, the Services, or any of its Services related products (including third party material and advertisements on the Website);

d)     costs incurred as a result of you using the Website, the Services or any of the products of Supp Society; and

e)     the Services or operation in respect to links which are provided for your convenience.

LIMITATION OF LIABILITY

Supp Society’s total liability arising out of or in connection with the Services or these Terms, however arising, including under contract, tort (including negligence), in equity, under statute or otherwise, will not exceed the resupply of the Services to you.

You expressly understand and agree that Supp Society, its affiliates, employees, agents, contributors and licensors shall not be liable to you for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. This shall include, but is not limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation and any other intangible loss.

COMPETITORS

If you are in the business of providing similar Services for the purpose of providing them to users for a commercial gain, whether business users or domestic users, then you are a competitor of Supp Society. Competitors are not permitted to use or access any information or content on our Website. If you breach this provision, Supp Society will hold you fully responsible for any loss that we may sustain and hold you accountable for all profits that you might make from such a breach.

TERMINATION OF CONTRACT

The Terms will continue to apply until terminated by either you or by Supp Society as set out below.

If you want to terminate the Terms, you may do so by:

a)     providing Supp Society with sixty (60) days' notice of your intention to terminate; and

b)     closing your accounts for all of the Services which you use, where Supp Society has made this option available to you.

c)     Your notice should be sent, in writing, to Supp Society via the 'Contact Us' link on our homepage.

Supp Society may at any time, terminate the Terms with you if:

a)     you have breached any provision of the Terms or intend to breach any provision;

b)     We are required to do so by law; or

c)     the provision of the Services to you by us is, in our opinion, no longer commercially viable.

Subject to local applicable laws, we reserve the right to discontinue or cancel your registration at any time and may suspend or deny, in its sole discretion, your access to all or any portion of the Website or the Services without notice if you breach any provision of the Terms or any applicable law or if your conduct impacts our name or reputation or violates the rights of those of another party.

INDEMNITY

You agree to indemnify Supp Society, its affiliates, employees, agents, contributors, third party content providers and licensors from and against:

a)     all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with your content;

b)     any direct or indirect consequences of you accessing, using or transacting on the Website or attempts to do so; and/or

c)     any breach of the Terms.

DISPUTE RESOLUTION

If you have a concern or dispute, please contact us by email at info@suppsociety.com.au. We will review the matter and respond in a timely manner.

All disputes will be handled at our discretion and in accordance with applicable Australian laws. We are committed to resolving disputes fairly, promptly and in good faith.       

GOVERNING LAW

This Agreement is governed by the law in force in the ACT and each party submits to the exclusive jurisdiction of the courts of ACT, Australia.

SEVERANCE

If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force.
